Terms of Service
Effective: June 28, 2026 · Jurisdiction: Ontario, Canada (PIPEDA) · Governing law: Ontario. By creating an account or using ST8GE, you agree to these Terms. If you do not agree, do not use the service.
1. Who can use ST8GE
ST8GE is a tool for licensed real estate professionals — and people expressly authorized by one — to create AI virtual-staging visualizations for properties they have authorization to photograph and market. You must be at least 18 years old. By creating an account you confirm you meet these criteria.
ST8GE is not intended for consumers, buyers, or the general public as primary users. If you are a buyer or member of the public who has received a shared tour link, your use of that link is governed by these Terms as a viewer.
2. Your content and the rights you grant us
"Your Content" means the photos, agent branding, property descriptions, buyer notes, and other materials you upload or generate through ST8GE. You retain full ownership of Your Content.
By uploading content, you grant ST8GE ("ST8GE," "we," "us") a worldwide, royalty-free, non-exclusive license to host, process, transform (including via AI), store, display, and distribute Your Content solely to operate and improve the service for you and for the buyers you share links with. We do not sell, license, or share Your Content with third parties for their independent commercial use.
You represent and warrant that:
- You own Your Content or have all necessary permissions, licenses, consents, and authorizations (including from MLS, listing photographers, property owners, and any applicable brokerage) to upload it and to authorize AI-generated derivatives;
- Your Content does not infringe any third party's intellectual property, privacy, or publicity rights;
- Your Content does not violate any applicable law, MLS rule, Fair Housing or human-rights regulation, the NAR Code of Ethics, or — for Canadian REALTORS® — the CREA REALTOR® Code and any provincial regulator rules (e.g., RECO in Ontario, OACIQ in Quebec).
You agree to indemnify and hold ST8GE, its officers, directors, employees, and contractors harmless from any claims, damages, or costs (including reasonable legal fees) arising from Your Content or your breach of these representations.
3. AI-generated renders — what they are and are not
Critical disclosure. Every image produced by ST8GE is an AI-generated visualization. It is not a photograph. It does not represent the actual condition, furnishings, fixtures, or features of any property. Furniture, decor, and finishes shown are illustrative only and are not available for purchase through ST8GE.
All rendered images carry a non-removable "Virtually Staged" badge. You agree not to remove, obscure, crop, or alter this badge in any share, export, listing, or marketing material. This badge is designed to satisfy the disclosure requirements of NAR Code of Ethics Article 12, the CREA REALTOR® Code, applicable MLS and provincial regulator rules, and state-level virtual-staging disclosure laws (including California, Florida, New York, and other jurisdictions as enacted). Removing or obscuring the badge may constitute a violation of professional licensing obligations and consumer-protection law.
ST8GE makes no representation that rendered visualizations will improve sale price, reduce days on market, or achieve any particular commercial outcome.
4. Brand references and third-party trademarks
Budget tier descriptions reference furniture and decor brands (IKEA, West Elm, Herman Miller, etc.) as illustrative style references only. ST8GE is not affiliated with, endorsed by, or in partnership with any of these brands. References do not imply that rendered items are available for purchase from those brands or that any brand has approved our use of their aesthetic.
5. Acceptable use
You agree not to:
- Upload photos you do not have the right to use;
- Use ST8GE to create misleading, discriminatory, or fraudulent property listings;
- Violate the U.S. Fair Housing Act, the Equal Credit Opportunity Act, applicable provincial or state human-rights or anti-discrimination laws, or Canada's Human Rights Act in your use of staging styles or buyer profiling;
- Attempt to reverse-engineer, scrape, copy, or republish ST8GE's AI outputs at scale for competitive purposes;
- Use ST8GE to train competing AI models;
- Share access credentials or circumvent usage limits;
- Upload photos of occupied residential properties without the occupant's explicit consent;
- Represent AI-rendered images as actual property photographs in any MLS listing, advertisement, or disclosure document;
- Send marketing calls, texts, or emails to buyers through ST8GE's lead-capture flows in violation of the U.S. Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL), or any applicable state "Mini-TCPA" or do-not-call rules.
6. Subscription, payment, and early adopter terms
ST8GE currently offers free access during our early adopter launch period (the "Launch Window"). The Launch Window is expected to last approximately 1–3 months from the date of App Store availability, ending when we reach internal milestone thresholds at our sole discretion.
After the Launch Window, paid subscription tiers will activate. Users who signed up during the Launch Window ("Founding Members") will receive advance notice before any paid tier begins and will be offered a discounted founding rate. We are not obligated to any specific discount amount or duration, but we will honor commitments communicated to you in-app at the time of signup.
All subscription pricing, billing terms, refund policies, and cancellation procedures will be published before any paid tier activates. Apple App Store and Google Play Store subscribers are subject to those platforms' payment and refund policies; ST8GE cannot override or refund App Store purchases.
7. Service availability and AI accuracy
ST8GE is provided "as is" and "as available." We do not guarantee uninterrupted availability, specific render times, or that AI outputs will meet any particular standard of quality or accuracy. Render times and quality may vary based on model availability, server load, and image complexity. AI models may occasionally produce outputs that are inaccurate, unexpected, or inconsistent. You are responsible for reviewing all renders before sharing them with clients.
8. Limitation of liability
To the maximum extent permitted by applicable law, ST8GE and its affiliates, officers, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising from or related to your use of or inability to use the service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of: (a) the total amount you paid to ST8GE in the 12 months preceding the claim, or (b) CAD $100.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
9. Tour and shortlist expiry
Shared tour links expire 24 hours after generation. Client shortlists expire 30 days after creation. We do not guarantee that expired content will be recoverable. You should save or export any content you need to retain before expiry.
10. Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, any applicable law, or any MLS or professional licensing rule. You may close your account at any time through the sign-out and account deletion flow in the app. Upon termination, your right to use the service ceases immediately. We will delete your account data within 30 days of a deletion request, subject to legal retention obligations.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the version date at the top of this page and, for material changes, notify you via the email address on your account at least 14 days before the change takes effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
12. Governing law and dispute resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the courts of Ontario, Canada. Nothing in this section deprives you of the protection of mandatory consumer-protection laws of your province, state, or country of residence, and U.S. residents retain any non-waivable rights under their state's consumer-protection statutes.
13. DMCA and copyright (U.S.)
ST8GE complies with the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe content on ST8GE infringes your copyright, send a written notice containing the information required by Section 512(c)(3) to our designated agent at dmca@st8ge.app. We will remove or disable access to material we determine to be infringing and will terminate the accounts of repeat infringers in appropriate circumstances. Misrepresentations in a DMCA notice may subject you to liability under § 512(f).
